RETURN AND REFUND POLICY
Last Updated: Sep 2026
As Kateryna Chernetska (“we”, “us”, “our”), we take pride in the design, creation, and secure packaging of our original handmade textile geometric artworks (the “Artworks”). Because each Artwork is a unique, irreplaceable physical creation, we have established a clear returns framework in strict compliance with European Union consumer protection laws (Burgerlijk Wetboek - BW and EU Directive 2011/83/EU).
This document forms an integral part of our overarching Terms & Conditions. By completing a purchase on katerynachernetska.com, you acknowledge and agree to the return timeframes, condition requirements, and financial responsibilities outlined below.
1. STATUTORY RIGHT OF WITHDRAWAL (EU/EEA CONSUMERS ONLY)
If you are a private consumer residing within the European Union (EU) or European Economic Area (EEA), you possess a statutory legal right to withdraw from this purchase agreement within fourteen (14) calendar days without providing any justification.
The 14-day cancellation window begins on the exact calendar day you (or a designated third party acting on your behalf, excluding the logistics carrier) take physical possession of the Artwork package.
1.1 Exercise Procedure
To exercise this right, you must notify us before the 14-day window expires by sending an explicit, written statement via email to info@katerynachernetska.com. Verbal notices or unauthorized package returns sent without prior written email approval will not be accepted.
2. MANDATORY RETURN LOGISTICS PROCEDURE
Following our written email approval of your withdrawal request, you must dispatch and return the Artwork to us without undue delay, and no later than fourteen (14) calendar days from the date of your withdrawal notification.
Pre-Approval & Address Verification: Do not return an Artwork without prior email authorization. Delicate textile creations require specialized handling, and we must supply you with the correct studio return address and logistical instructions.
Original Protective Packaging: The Artwork must be returned in its original protective packaging or an equivalent professional art-grade packaging capable of ensuring safe transit without structural damage.
Tracked & Registered Transit: The return shipment must be executed via a reputable courier service that provides full electronic end-to-end tracking and requires a physical signature upon delivery. You must email the live tracking details to us immediately upon dispatch.
3. ALLOCATION OF RETURN SHIPPING COSTS AND CUSTOMS
Unless the return is due to a verified transport defect or transit damage incurred during the initial outbound journey (see Section 6), the cost of return shipping, transport insurance, and international customs clearing fees is borne exclusively by the Buyer.
For international shipments, the Buyer must declare the parcel explicitly as “RETURNED GOODS - FAILED SALE” on all official customs and postal clearance documentation to prevent unnecessary border duties at our threshold. If import tariffs or administration fees are charged to us due to improper declaration by the Buyer, the exact value of those charges will be deducted from the final refund sum.
4. STRUCTURAL CONDITION ASSESSMENT & DIMINISHED VALUE
To qualify for a full financial refund under the right of withdrawal, the Artwork must be returned to our studio in its original, immaculate, and completely unaltered condition, accompanied by any certificates of authenticity provided.
4.1 Condition Requirements & Inspection Limits
You may inspect the Artwork only to the extent necessary to evaluate its visual parameters and characteristics, as you would within a physical art gallery.
You remain financially liable for any diminished value resulting from handling beyond this scope. We reserve the right to deduct a value reduction fee or reject a refund if a returned piece shows signs of handling, surface damage, altered thread tension, or exposure to environmental smoke or odours while in your care.
5. INTERNATIONAL BUYERS OUTSIDE THE EU
For purchases executed by buyers residing outside the European Union or European Economic Area (including the United States, Canada, the United Kingdom, Switzerland, and Asia), all sales are final. The statutory EU right of withdrawal does not apply to non-EU orders unless required by mandatory local consumer laws.
We do not offer voluntary returns for non-EU international buyers due to high logistical risks, international border clearance complications, and transit vulnerabilities associated with shipping delicate textile art across long distances. Non-EU international sales are exempt from returns unless the Artwork arrives critically damaged from outbound transit (Section 6).
6. OUTBOUND TRANSIT DAMAGE PROTOCOLS (48-HOUR WINDOW)
Our return restrictions do not restrict your statutory rights if an Artwork arrives damaged due to outbound courier mishandling:
Accept the package from the courier and capture clear, high-resolution photographs of the damaged exterior packaging before opening.
Carefully unpack the item and capture clear, high-resolution photographs of the physical damage sustained by the canvas or textile threads.
Transmit these visual proofs along with your order details to info@katerynachernetska.com within forty-eight (48) hours of physical delivery.
Upon validation, we will initiate an insurance claim with our logistical carrier, coordinate a return at our expense, and issue a complete refund or replacement arrangement. Failure to notify us within 48 hours invalidates our transit carrier insurance coverage and will result in the rejection of the damage claim.
7. REFUND SETTLEMENT PROCESS
Once the returned Artwork is received and inspected by our studio to verify its structural condition, the refund will be processed via the original payment method utilized during checkout.
Outbound Shipping Reimbursement (EU Only): In accordance with EU regulations, standard outbound shipping costs paid at purchase will be refunded. If you selected a premium or express shipping option at checkout, only the standard baseline shipping cost will be reimbursed.
Settlement Timeline: Refunds are authorized within fourteen (14) calendar days from the date the Artwork is physically received and inspected at our studio.
We accept no liability for third-party bank processing delays, localized transaction charges, or currency conversion fluctuations.
8. LEGAL EXCEPTIONS
Pursuant to Art. 6:230p sub f of the Dutch Civil Code (BW) and EU law, the statutory right of withdrawal and return privileges are completely excluded for:
Custom & Commissioned Artworks: Works created to individual customer specifications, bespoke sizes, or personalized color schemes.
Altered Artworks: Items that have been re-framed, unmounted, or structurally modified at the Buyer’s request after delivery.
B2B Corporate Acquisitions: Commercial purchases executed by corporate entities outside private consumer frameworks.
